LOCAL COUNCILS ACT (CAP. 363)
Beverages in Glass Containers
(San :iljan Local Council) Bye-Laws, 2004
IN exercise of the powers conferred by articles 34 and 60 of the Local Councils Act, and in conformity with the provisions of article
35 (8) of the said Act, San :iljan Local Council has made the following Bye-Laws>–
1.1 The title of these Bye-Laws is Beverages in Glass Containers
(San :iljan Local Council) Bye-Laws, 2004.
1.2 These Bye-Laws shall come into force on the date of their publication in the Gazette.
2. In these Bye-Laws, unless the context otherwise requires>- “Act” means the Local Councils Act<
“Council” means the San :iljan Local Council<
“glass container” includes glass bottles, glasses, and, or any other glass container intended for the serving of any beverages<
“locality” means the locality of San :iljan<
“public place” means the streets within the San :iljan locality as shown in Schedule A to these Bye-Laws.
3.1 No person is permitted to loiter in any public place holding or having on his person any glass containers.
3.2 Any commercial establishment situated within any street or place as indicated in Schedule A selling beverages, shall>-
(a) affix a notice in Maltese as well as in English as shown in Schedule B to these Bye-Laws, which notice shall be placed in a
conspicuous place and be easily legible by the patrons of such commercial establishment< and

(b) provide containers made of a material other than glass if such beverage is to take place in any public place.
4. Any person who is in breach of any of the provisions of these Bye-Laws shall, on conviction, be liable to a fine (ammenda) of twenty liri (Lm20) for such contravention, and to a further fine (ammenda) of five liri (Lm5) for every day during which any of the provisions of these Bye-Laws is breached.
