CIVIL AVIATION ACT (CAP. 232)
Civil Aviation (Denied Boarding Compensation and Assistance to Passengers) (Designation of Competent Authority) (Amendment) Regulations, 2007
IN exercise of the powers conferred by article 3 of the Civil Aviation Act, the Minister for Competitiveness and Communications hereby makes the following regulations>-
1. The title of these regulations is the Civil Aviation (Denied Boarding Compensation and Assistance to Passengers) (Designation of Competent Authority) (Amendment) Regulations, 2007 and it shall be read and construed as one with the Civil Aviation (Denied Boarding Compensation and Assistance to Passengers) (Designation of Competent Authority) Regulations, 2005 hereinafter referred to as “the principal regulations”.
2. Regulation 2 of the principal regulations shall be renumbered as regulation 3 thereof, and immediately after regulation 1 there shall be inserted the following>-

“Interpretation.

2. In these regulations, unless the context otherwise
requires -
“Director of Civil Aviation” means the Director of Civil Aviation and, to the extent of the authority given, any person on that behalf by the Director<
“Regulation 261#2004” means Regulation (EC) No
261#2004 of European Parliament and of the Council of
11 February 2004 establishing common rules on compensation and assistance to passengers in the event of denied boarding and of cancellation or long delay of flights, and repealing Regulation (EEC) No 295#91<
“Regulation 2006#2004” means Regulation (EC) No 2006#2004 of the European Parliament and of the Council of 27 October 2004 on cooperation between

regulation 3 as renumbered of the principal

national authorities responsible for the enforcement of consumer protection laws of the Regulation on consumer protection cooperation.”.
3. For regulation 3 as renumbered of the principal regulations there shall be substituted the following>

regulations.

Powers of designated person.

“3. For the purpose of Article 16 of Regulation (EC) No. 261#2004, the Director of Civil Aviation is the designated person responsible for the investigation and enforcement of the provisions of the said EC Regulation as regards flights from airports situated in Malta and flights from a third country to Malta, and shall have the powers designated to competent authorities under Article 4 of Regulation (EC) No. 2006#2004.”.

Adds new

regulation 4

to the principal regulations.

4. Immediately after regulation 3 as renumbered of the principal regulations there shall be added the following new regulation>-

“Offences and

penalties.

4. (1) No person shall obstruct or impede the Director of Civil Aviation in the exercise of any powers or duties under these regulations.
(2) A person found guilty of an offence under this regulation shall be liable on summary conviction to a fine (multa) of not less than Lm250 but not exceeding Lm1000.”.
