CRIMINAL CODE (CAP. 9.)Drawing of Jurors by means of aComputerised Mechanism Regulations, 2011

IN exercise of the powers conferred by article 606(1) of the Criminal Code, the Minister for Justice and Home Affairs has made the following regulations:-

1. (1) The title of these regulations is the Drawing of

Jurors by means of a Computerised Mechanism Regulations, 2011.
(2) These regulations shall come into force on the 1st March,
2011.

2. For the purposes of these regulations the expression

"computerised program" shall mean the Jurors’ Program.

3. (1) There shall be a computerised program, containing the list of jurors drawn according to the provisions of the Criminal Code to serve as jurors before the Criminal Court, which computerised program will be under the responsibility of and utilised by the Registrar of Criminal Courts and Tribunals or by such other persons he may choose to delegate.

(2) The computerised program shall be accessible only to those persons identified by the Registrar from time to time.

4. (1) The data of this system shall be kept in the computerised program of the Court and any adjustment or change in such data shall be registered in the program itself.

(2) The computerised program utilises as a method of selection the random drawing of jurors.
(3) The list of jurors, once issued by the Board of Jurors in terms of article 606 of the Criminal Code, shall be inserted in the computerised program kept for that purpose by the Registrar, from which list there shall be selected and drawn such jurors as the Court may order to be drawn.

5. (1) The names of the persons selected as jurors by the computerised program according to article 605(11) of the Criminal

Code shall be divided into two categories: (a) jurors and (b) special jurors.
(2) These lists shall be kept in the computerised program according to article 605(12) of the Criminal Code under the responsibility of the Registrar in a safe manner.

6. The lists of jurors drawn by the computerised program shall be published in the Gazette in the same mode and manner determined by article 606(5) of the Criminal Code.7.
