DEVELOPMENT PLANNING ACT (CAP. 356)
Development Planning (Use Classes) (Amendment) Order, 2004
IN virtue of the powers conferred on it by article 31 of the Development Planning Act, the Malta Environment and Planning Authority, with the concurrence of the Minister for Rural Affairs and the Environment, and in consultation with the Kamra tal-Periti, has made the following order>
1. The title of this Order is the Development Planning (Use Classes) (Amendment) Order, 2004, and shall be read and construed as one with the Development Planning (Use Classes) Order, 1994, hereinafter referred to as “the principal order”.
2. Article 2 of the principal order shall be amended as follows>– (a) immediately after the definition “class”, there shall be
added the following new definition>
“ “dangerous substance” means a substance, mixture or preparation listed in Schedule 1, Part 2 of the Control of Major Accident Hazards Regulations or fulfilling the criteria laid down in Schedule 1, Part 3 of the said regulations and present as a raw material, product, by-product, residue or intermediate, subject to the exclusions in sub-regulation (2) of regulation 4 of the said regulations<”<
(b) the definitions “hazardous substance” and “notifiable quantity” shall be deleted< and
(c) immediately after the definition “MDC”, there shall be added the following new definition>
“ “Control of Major Accident Hazards Regulations”
means the Control of Major Accident Hazards Regulations,
2003<”.

3. Paragraph (l) of Article 4 of the principal order shall be substituted as follows>
“(l) Manufacturing, processing, keeping or storing of a dangerous substance, in a building or on land<”.
