ENEMALTA ACT (CAP. 272)
IN EXERCISE of the powers conferred by article 39 of the Enemalta Act, Enemalta, with the approval of the Minister for Economic Services
and the Malta Resources Authority, has made the following regulations>
1. The title of these regulations is the Electricity Supply (Amendment) Regulations, 2003 and shall be read and construed as one
with the Electricity Supply Regulations, 1939, hereinafter referred to as “the principal regulations”.
2. In regulation 43 of the principal regulations for the words “sub- paragraph (1) of paragraph (2) of the Fourth Schedule to
these regulations”, there shall be substituted the words> “sub-paragraph (ii) of Tariff 1 or subparagraph (ii) of Tariff 2
of the Fourth Schedule to these regulations if the main meter of the establishment of the owners or operators registers in kWh or
kVAh respectively.”
3. Regulation 44 of the principal regulations shall be deleted.
4. In the TARIFF FOR METER CHARGE AND FOR THE SUPPLY OF ELECTRICITY TO COMMERCIAL PREMISES in the Second Schedule to the principal
regulations>–
(a) in paragraph (1) thereof, immediately after the words
“3c7 per unit”, there shall be added the following>–
“Consumers whose service is rated above 100 Amps per phase may choose to have their consumption metered in kVAh rather than kWh
and shall be charged at the following rate>
Meter Charge Lm24 per annum
For every kVAh unit of consumption 3c4 per kVAh
“Consumers who wish to be charged at the above rate are to inform the Chairman in the manner and form prescribed by the Corporation”<
and
Citation.

Amends regulation
43 of the principal regulations.
Deletes regulation
44 of the principal regulations.
Amends the Second Schedule to the principal regulations.

(b) in paragraph (2) thereof, immediately after the words
“3c6 per unit”, there shall be added the following>
Consumers whose service is rated above 100 Amps per phase may choose to have their consumption metered in kVAh rather than kWh and
shall be charged at the following rate>
Meter Charge Lm24 per annum For every kVAh of consumption 3c3 per kVAh Consumers who wish
to be charged at the above rate are
to inform the Chairman in the manner and form prescribed
by the Corporation.”
5. In the Fourth Schedule to the principal regulations, for paragraphs 1 and 2 thereof, there shall be substituted the following>–
“1. Consumers whose service is rated above 100 Amps per phase supplied with electricity for use in or for the purposes of industrial
premises shall have the option of choosing to be charged on either of the next two following tariffs> -
(a) Tariff One
Electricity consumption will be metered in kWh and Maximum Demand in kW –
(i) The first part of the tariff be a meter charge of Lm24 per annum and will include the free consumption of 200 units in the second
part of this tariff<
(ii) The second part of the tariff shall be at the rate of 2c8 per unit of consumption<
(iii) The third part of the tariff shall be at the rate of Lm8 per annum per kW of the Maximum Demand made in any period during
the year.
(b) Tariff Two
Electricity consumption shall be metered in kVAh units and Maximum Demand in kVA –
(i) The first part of the tariff shall be a meter charge of Lm24 per annum<
(ii) The second part of the tariff shall be at the rate of 2c6 per kVAh unit of consumption<
(iii) The third part of the tariff shall be at the rate of Lm7.5 per annum per kVA of maximum demand registered in any period during
the year.
Consumers who wish to be charged under tariff 2 are to inform the Chairman in the manner and form prescribed by the Corporation.
2. Consumers whose main use of electricity is for industrial production or industrial services, and whose consumption exceeds
5,000,000 units (in the case of consumers who opt for consumption metering in Board of Trade units) or 5,500,000 kVAh units may select
to be charged on either of the next two following tariffs>
(c) Tariff Three
Electricity consumption will be metered in kWh and maximum demand in kVA –
(i) The first part of the tariff shall be at the rate of
2c5 per kWh on the consumption registered between
06.00 hours and 22.00 hours of the same day<
(ii) The second part of the tariff shall be at the rate of 2c3 per kWh on the consumption registered between 22.00 hours of one
day and 06.00 hours of the following day<
(iii) The third part of the tariff shall be at the rate of Lm 6.70 per kVA registered in any period during the year.
(d) Tariff Four
Electricity consumption will be metered in kVAh units and maximum demand in kVA –
(i) The first part of the tariff shall be at the rate of
2c4 per kVAh on the consumption registered between
06.00 hours and 22.00 hours of the same day<
(ii) The second part of the tariff shall be at the rate of 2c2 per kVAh on the consumption registered

between 22.00 hours and 06.00 hours of the following day<
(iii) The third part of the tariff shall be at the rate of Lm6.70 per kVA of the maximum demand registered in any period during
the years.
Eligible customers who wish to be charged under tariff
4 are to inform the Chairman in the manner and form prescribed by the Corporation.”.
