EUROCONTROL ACT (CAP. 333)Civil Aviation (Route Charges for Navigation Services) (Amendment) Regulations, 2009

IN exercise of the powers conferred by article 3 of the Eurocontrol Act, the Minister for Infrastructure, Transport and Communications, with the concurrence of the Minister of Finance, the Economy and Investment, has made the following regulations:

(Route Charges for Navigation Services) (Amendment) Regulations,
2009 and they shall be read and construed as one with the Civil
Aviation (Route Charges for Navigation Services) Regulations,
2002 hereinafter referred to as “the principal regulations”.
(2) These regulations shall be deemed to have come into force on the 1st January, 2009.

“(2) The charge shall constitute remuneration for the costs incurred by Malta Air Traffic Services Limited in respect of en-route air navigation facilities and services and the operation of the Route Charges System. It shall also constitute remuneration for the costs incurred by the Department of Civil Aviation in respect of its regulatory function and for the costs incurred by Eurocontrol in operating the System.
(3) EUROCONTROL shall assess and collect the charge due and reimburse Malta Air Traffic Services Limited and the Department of Civil Aviation in accordance with the applicable rules.”.
