EXPLOSIVES ORDINANCE (CAP. 33)

The Civil Explosives (Identification) Regulations, 2005

IN exercise of the powers conferred by article 22 of the Explosives Ordinance, the Minister for Justice and Home Affairs has made the following regulations:

1. The title of these regulations is the Civil Explosives

(Identification) Regulations, 2005.

2. These regulations implement the provisions of Commission

Directive 2004/57/EC of 23 April 2004.

3. The First Schedule to these regulations lists, for the purposes of implementing the second and in part the third indent of regulation 1(2) of the Civil Explosives Regulations, 2004 (L.N. 279 of 2004

), the articles considered in the relevant United Nations recommendations to be pyrotechnic articles or ammunition.

4. The Second Schedule to these regulations lists articles in respect of which a determination is required, for the purposes of implementing the second indent of regulation 1(2) of the Civil Explosives Regulations, as to whether those articles are pyrotechnic articles or explosives.
