Amends regulation
3 of the principal regulations.

ENVIRONMENT PROTECTION ACT (CAP. 435)
Limitations of Emissions of Certain Pollutants into the Air from
Large Combustion Plants (Amendment) Regulations, 2008
BY virtue of the powers conferred by articles 9 and 10 of the Environment Protection Act, the Minister for Rural Affairs and the Environment
has made the following regulations>–
1. The title of these regulations is the Limitations of Emissions of Certain Pollutants into the Air from Large Combustion Plants (Amendment) Regulations, 2008 and they shall be read and construed as one with the Limitations of Emissions of Certain Pollutants into the Air from Large Combustion
Plants Regulations, 2002 hereinafter referred to as “the principal regulations.”
2. Regulation 3 of the principal regulations shall be amended as follows>
(a) for subregulation (2) thereof, there shall be substituted the following>
“(2) Plants powered by diesel, petrol and gas engines irrespective of the fuel used, shall not be covered by these regulations.”<
and
(b) immediately after subregulation (2) thereof, there shall be added the following new subregulation>
“(3) Where two or more separate new plants are installed in such a way that, taking technical and economic factors into account,
their waste gases could, in the judgement of the competent authorities, be discharged through a common stack, the combination formed
by such plants shall be regarded as a single unit.”.
