ENVIRONMENT PROTECTION ACT (CAP. 435)Waste Management (Landfill) (Amendment) Regulations, 2007
Title.
L.N. 168 of
2002.
Amends regulation 1 of the principal regulations.
IN exercise of the powers conferred by articles 9 and 10(2) of the Environment Protection Act, the Minister for Rural Affairs and the Environment has made the following regulations:-
1. The title of these regulations is the Waste Management (Landfill) (Amendment) Regulations, 2007, and they shall be read and construed as one with the Waste Management (Landfill) Regulations, 2002, hereinafter referred to as "the principal regulations".2. Immediately after sub-regulation (3) of regulation 1 of the principal regulations there shall be added the following new sub- regulation:L.N. 230 of 2004

"(4) In respect of the technical characteristics of landfills, these regulations contain, for those landfills to which the Integrated Pollution Prevention and Control Regulations, 2002, are applicable, the relevant technical requirements in order to elaborate in concrete terms the general requirements of thos e re gulat i ons. The relevant requirements of the Integrated Pollution Prevention and Control Regulations, 2002, shall be deemed to be fulfilled if the requ irements of these regulations are complied with.".
Amends regulation 4 of the principal regulations.
Amends regulation 17 of the principal regulations.
3. In regulation 4 of the principal regulations, for the words "There shall be three classes of landfill:" there shall be substituted the words "Each landfill shall be classified in one of the following classes:".4. Immediately after paragraph (b) of regulation 17 of the principal regulations there shall be added the following new proviso:"Provided that the Competent Authority shall take necessary measures to ensure that sites which have not been granted, in accordance with regulation 10, a permit to continue to operate, shall be closed down as soon as possible, in accordance with regulations 9(g) and 16.".
