FOOD SAFETY ACT (CAP. 449)
Nutrition and Health Claims Regulations, 2008
IN exercise of the powers conferred by article 10 of the Food Safety Act, the Minister of Health, the Elderly and Community Care has made the following regulations>-
1. (1) The title of these regulations is the Nutrition and Health
Claims Regulations, 2008.
(2) These regulations contain the provisions necessary for the implementation of Regulation (EC) No 1924#2006 of the European Parliament and of the Council of 20 December, 2006 on nutrition and health claims made on foods.
2. The Directorate responsible for foodstuffs within the Malta Standards Authority is hereby designated as the responsible national authority referred to in Regulation (EC) No 1924#2006, hereinafter referred to as the Competent Authority.
3. (1) To facilitate efficient monitoring, when a food bearing a nutrition claim listed in the Annex of Regulation (EC) No 1924#2006, or a health claim is placed on the market for the first time, the manufacturer or importer shall notify the Competent Authority by forwarding a model of the label used for the product.
(2) In the case of food bearing health claims placed on the market prior to the entry into force of these regulations, the notification prescribed by sub-regulation (1) hereof shall take place by not later than 30th June 2008. Foodstuffs which have not been notified by that date shall be removed from the market at the expense of the manufacturer or importer.
(3) (a) In the case of food bearing nutrition claims placed on the market prior to the entry into force of these regulations, the notification prescribed by sub-regulation (1) hereof shall take place by not later than>
(i) 30th June, 2008 for food bearing nutrition claims referring to fat<

(ii) 31st December, 2008 for food bearing nutrition claims referring to energy<
(iii) 30th June, 2009 for food bearing nutrition claims other than those referred to in paragraphs (i) and (ii).
(b) Foodstuffs which have not been notified by the dates prescribed in paragraphs (i), (ii) and (iii) shall be removed from the market at the expense of the manufacturer or importer.
