FISHING WATERS (DESIGNATION) AND
EXTENDED MARITIME JURISDICTION ACT
To make special provision for the designation of fishing waters and the extension of maritime jurisdiction.

Act X of 2005.
1. The short title of this Act is the Fishing Waters
(Designation) and Extended Maritime Jurisdiction Act.
2. (1) Subject to the provisions of subarticle (2), the Prime Minister may by Order published in the Gazette claim sovereign rig h
ts for Mal t a, fo r t h e p u rp ose o f ex plo r in g an d ex ploi tin g, conserving and managing the living and, or non-living
natural resources therein, over such areas of the marine waters beyond the li mi ts la id d o w n in ar t i cl e 3 ( 2) o f th e
Te rr it ori a l Wa t e rs an d Co nt ig uo us Zo ne Ac t as ma y be d e si gn ate d in t h e O r der and thereupon the areas so designated shall constitute part of the fishing waters of Malta
as provided in article 3( c ) of the Fis h er ies Conservation and Management Act.
(2) The Prime Minister may also by Order published in the G a zette p r ov ide f o r t h e exercise of jur i sdicti on beyo
nd the territorial waters of Malta with regard to -
(a) the establishment and use of artificial islands, installations and structures;
(b) marine scientific research; and
(c) the protection and preservation of the maritime environment.
(3) Any Order made under this article may contain any such terms or conditions as the Prime Minister may deem appropriate.
