HOUSING AUTHORITY ACT (CAP. 261)Housing Authority (Transfer of Assets) Order, 2011

IN exercise of the powers conferred by article 12 of the Housing Authority Act, the President of Malta has made the following order:-

Citation.

Specified property.

Appointed day.

Description of specified property.

1. The title of this order is the Housing Authority (Transfer of Assets) Order, 2011.2. The property described in article 4 of this order is hereby specified for the purpose of article 12 of the Housing Authority Act.3. The property specified in article 2 of this order shall be transferred and vest in the Housing Authority as provided in the aforesaid article with effect from the 4th January, 2011.4. The property referred to in article 2 of this order is the following, that is to say:

(1) Plots of land in Ta’ Xlejli Housing Estate, limits of Gudja, consisting of Plots 24 to 31 and 48 to 55 and having an area of approximately 4,000 square metres. The land is bounded on the North-West by Vjal it-Torri, on the North-East by Triq il-Markiża, and on the South-West by property transferred to the Housing Authority, and it falls on Government Property acquired by President’s Declarations
1094, 1095, 1096, 1097 and 1098 dated 3rd November
2010. The land is registered as Tenement No. E26180 and is indicated edged in red on plan L.D. 23_86_7. (HAM 159/81
Vol 2).
( 2 ) A p l o t o f l a n d k n o w n a s P l o t 11 , i n S q a q Sant’Anġlu, forming part of Ta’ L-Isqof Government Housing Estate, in Ħal Kirkop, having an area of approximately 180 square metres, bounded on the North-West by Government property granted on temporary emphyteusis, on the South-

East by Sqaq Sant’Anġlu, and on the South-West by property transferred to the Housing Authority. The plot is subject to a perpetual emphyteusis as per Deed No. 173 dated 24th April,
1971 in the acts of Notary A. Grech, and it falls on part of
Government property formerly registered as Tenement No.
51113, is registered in the Estate Management Department records as Tenement 41572, and is edged in red and marked “PL. 11” on plan L.D. 24/97/1. (HAP 4/2010).
(3) A plot of land known as Plot 120, at Triq il- Ġizi, forming part of the San Ġwann Government Housing Estate, Neighbourhood II, in San Ġwann, having an area of approximately 109 square metres, bounded on the North by Triq il-Ġizi, on the East by Government property granted on temporary emphyteusis, and on the South by Triq ir- Riħan. The plot is subject to a temporary emphyteusis as per Deed No. 228 dated 9th November, 1973 in the acts of Notary A. Grech, falling on part of Government property formerly registered as Rural Tenement No. 51328. The plot is registered in the Estate Management Department records as Tenement 66164 and edged in red and marked “P. 120” on plan L.D. 128/80/21. (HAP 5/2010).
(4) A plot of land known as Plot 121, at Triq il- Ġizi, forming part of the San Ġwann Government Housing Estate, Neighbourhood II, in San Ġwann, having an area of approximately 109 square metres, bounded on the North by Triq il-Ġizi, on the West by Government property and granted on temporary emphyteusis, and on the South by Triq ir-Riħan. The plot is subject to a temporary emphyteusis as per Deed No. 191 dated 15th May, 1971 in the acts of Notary A. Grech, falling on part of Government property formerly registered as Rural Tenement No. 51328. The plot is registered in the Estate Management Department records as Tenement 66165 and edged in red and marked “P. 121” on plan L.D. 128/80/21. (HAP 1/2010).
(5) A plot of land consisting of Plot 219 and Site
A in Triq il-Bruka, on which are built premises numbered
18, forming part of the Santa Luċija Government Housing Estate, Phase III, in Santa Luċija, having a total area of approximately 167 square metres. Plot 219 has an area of approximately 145 square metres and is subject to a perpetual emphyteusis as per Deed No. 335/76/G dated 15th September
1976 in the acts of Notary A. Grech. Site A has an area of

approximately 22 square metres and is subject to a perpetual emphyteusis as per Deed No. 64/81 dated 8th April, 1981 in the acts of Notary G. Grima. Plot 219 is edged in red and numbered as “P. 219” and Site A is edged in red and marked as ‘A’ on L.D. 11/82/81, and the whole plot is bounded on the West by Triq il-Bruka, and on the North and on the South by private property, and it falls on part of Government property acquired by Deed 545/74 dated 22nd July, 1974 and Deed
550/75 dated 13th June, 1975, both in the records of Notary
A. Attard. (HAP 4/2009).
