VERŻJONI ELETTRONIKA B 5LOCAL COUNCILS ACT (CAP. 363)Local Councils (Delegation of Enforcement) (Amendment) Order, 2011

IN exercise of the powers conferred by articles 33(1), 36(6) and 72 of the Local Councils Act, the Prime Minister has made the following order:-

1 of the principal Order, there shall be added the words “and
Regional Committees”.

(a) in sub-article (1) thereof, immediately after the words “Joint Committee”, there shall be added the words “or Regional Committee”;
(b) for sub-article (2) thereof, for the words from “The aforementioned delegation” to the words “Second Schedule:” there shall be substituted the following:
“(2) The aforementioned delegation shall take effect in relation to each Local Council or Regional Committee as from the date shown against that Local Council or Joint Committee or Regional Committee in the Second Schedule:”; and
(c) immediately after sub-article (2) thereof, there shall be inserted the following new sub-article:
“ ( 3 ) T h e M i n i s t e r m a y b y O r d e r w i t h d r a w the delegation given to any Local Council or Joint Committee or Regional Committee and such Order shall

come into effect as from the date shown in the Second
Schedule:
Provided that when that date is established, any notice of contravention issued by a Local Council s h a l l r e m a i n v a l i d a n d a n y p r o c e e d i n g s b e f o r e a tribunal or court shall be continued in the name of that Local Council until all proceedings in respect of that contravention have been exhausted.”.

Amends article 3 of the principal Order.

Amends the First

Schedule

to the principal Order.

Amends the Second

Schedule

to the principal Order.

) Regulation 68”.

( a ) f o r t h e w o r d s “ ( A r t i c l e 2 ( 2 ) ” t h e r e s h a l l b e susbstituted the words “Article 2 (2) and (3); and
(b) immediately after the column entitled “Effective date of delegation” there shall be inserted a new third column to be entitled “Termination date of delegation”.
