MERCHANT SHIPPING ACT (CAP. 234)
Merchant Shipping (Port State Control) (Amendment) Regulations, 2008
IN exercise of the powers conferred by articles 154 and 374 of the Merchant Shipping Act and article 28 of the Malta Maritime Authority Act, the Minister for Competitiveness and Communications has made the following regulations>–
1. The title of these regulations is the Merchant Shipping (Port State Control) (Amendment) Regulations, 2008, and shall be read and construed as one with the Merchant Shipping (Port State Control) Regulations, 2004, hereinafter referred to as “the principal regulations”.
2. For sub-regulation (1) of regulation 14 of the principal regulations, there shall be substituted the following>–

. Amends regulation

14 of the principal regulations.

“Professional profile of inspectors.

(1) Inspections under these regulations shall be carried out only by inspectors who fulfil the qualification criteria specified in Annex VII Minimum Criteria For Inspectors to Council Directive 95#21#EC.”.
3. Regulation 20 of the principal regulations shall be amended as follows>
(a) immediately after sub-regulation (2) thereof there shall be inserted the following new sub-regulation>
“(3) Where any person fails to comply with the provisions of sub-regulation (3) of regulation 6 and with those of regulation 15, such person shall be guilty of an offence in each case and shall for each offence be liable to a fine (multa) not exceeding one thousand units.”< and
(b) sub-regulation (3) thereof shall be renumbered as sub- regulation (4).

Amends regulation

20 of the principal regulations.
