MALTA TRAVEL AND TOURISM SERVICES ACT (CAP. 409)

Fees (Tourism) (Amendment) Regulations, 2005

IN exercise of the powers conferred by articles 7(3) and 47 of the Malta Travel and Tourism Services Act, the Minister for Tourism and Culture, acting on the recommendation of the Malta Tourism Authority, has made the following regulations:

1. (1) The title of these regulations is the Fees (Tourism) (Amendment) Regulations, 2005, and shall be read and construed as one with the Fees (Tourism) Regulations, 2002, hereinafter referred to as “the principal regulations”.

(2) These regulations shall be deemed to have come into force on the 1 January, 2005, other than the provisions of regulation
5 thereof relating to item M (Travel and Tourism Agents) in the Second Schedule to the principal regulations, which shall be deemed to have come into force on the 1 January, 2003.

2. For sub-regulation (1) of regulation 2 of the principal

Regulations, there shall be substituted the following:-
“ (1) In these regulations, unless the context otherwise requires“–
“applicable rate” means the fee charged by the Authority to tourism operations as appearing in the First and Second Schedules to these regulations;
“tourist areas” and “non-tourist areas” mean the areas specified as such in the Second Schedule to these regulations;
“tour operator representative” means an incoming tourism agent acting as a representative of a tour operator for leisure travel.”.

3. In sub-regulation (1) of regulation 5 of the principal regulations, immediately after the proviso thereto, there shall be added the following new proviso:-

4. For the First Schedule and the Second Schedule to the principal regulations, there shall be substituted the following:-
