PUBLIC ADMINISTRATION ACT (CAP. 497)Directives and Guidelines (Application to GovernmentEntities) Order, 2010
IN EXERCISE of the powers conferred by article 46 of the Public Administration Act, the Prime Minister has made the following order:–
Citation.
Application of article
38 of the Public Administration Act to government entities.
1. This order may be cited as the Directives and Guidelines(Application to Government Entities) Order, 2010.
2. (1) Article 38 of the Public Administration Act, hereinafter referred to as “the principal Act”, shall apply to government
entities as if every reference to government agencies in the said article were a reference to government entities.
(2) The obligation to comply with directives as set out in subarticle (2) of article 38 of the principal Act shall extend to members
of the board of directors or other governing body of a government entity and to any person functioning in a role equivalent to that
of Chief Executive Officer.
(3) Any directive issued to a government entity in accordance with this order shall not have effect if, and to the extent that,
it conflicts with the provisions of any law governing the entity.
