Ports And Shipping Act (Cap. 352) Small Ships (Amendment) Regulations, 2010 (L.N. 57 Of 2010 )

IN exercise of the powers conferred by articles 4(3) and 27 of the Ports and Shipping Act, the Minister for Infrastructure, Transport and Communications, in consultation with the Authority for Transport in Malta and in concurrence with the Minister of Finance, the Economy and Investment, has made the following regulations:

(2) These regulations shall be deemed to have come into force on the 10th of November, 2009.

(a) for sub-paragraph (ii) of paragraph (b) of sub- regulation (2) thereof, there shall be substituted the following:

“(ii) of, or exceeding, 30H.P., on the 1st of

January, 2011; and

(iii) not exceeding 30H.P., on such date as the

Minister may prescribe.”; and

(b) for paragraphs (b) and (c) of sub-regulation (3)

thereof, there shall be substituted the following:

“(b) to regulate water based recreational activities in the internal and territorial waters of Malta; and

(c) to regulate the preservation of good order in any part of the internal and territorial waters of Malta.”.

Amends regulation

1 of the principal regulations.

Substitutes the First Schedule to the principal regulations.

Amends the Third Schedule to the principal regulations.

(a) the item “Failure to give notice within the stipulated period of any modification to the small ship or any change in the details of registration………€100” shall be deleted; and

(b) the item “Change of ownership of a small ship not notified within the stipulated period………€200” shall be deleted.
