Publications (Qrendi Local Council) Bye-Laws, 2004
IN exercise of the powers conferred by articles 33, 34, 35(8) and
60 of the Local Councils Act, the Qrendi Local Council has made the following Bye-Laws>–
1.1 The title of these Bye-Laws is Publications (Qrendi Local
Council) Bye-Laws, 2004.
1.2 These Bye-Laws shall come into force one month after their publication in the Gazette.
2. In these Bye-Laws unless the context otherwise requires>– “Council” means the Qrendi Local Council<
“editorial board” means the person or group of persons nominated by the Council to be in charge of a Council publication<
“publication” includes any newspaper, journal, newsletter, book, brochure or other publication by the Council, as well as lapel badges and souvenirs made by the Council with an educational or cultural purpose.
3.1 The Council has the right to sell any publication.
3.2 In determining the price of any publication, this shall include all the elements to recover the expenses made in the production of the publication as well as a small margin of profit.
3.3 The Council may utilize any available means to promote and sell its publications, including the use of advertisements and the engagement of third persons, organizations or establishments.
3.4 Notwithstanding any authorization granted under these Bye- Laws, a person granted an authorization shall be personally responsible for any permits or licenses necessary under any other law.

Responsibility of the Council.

4.1 In the design stage of the publication, the editorial board shall ensure that the material used is of the highest quality, and that no articles be published which give an opinion which may be considered to be discriminatory, partisan or libellous.
4.2 The editorial board shall also ensure that besides conforming to all legislation which regulates the printing of publications, it takes due consideration of the needs of the consumer by, for example, ensuring that the price charged is reasonable or by ensuring that such publication is available from establishments which afford good access to persons with a disability.
4.3 On each publication, excluding lapel badges and souvenirs, there shall be clearly indicated>
(a) the name and address of the editorial board< (b) the date of publishing of the publication<
(c) the name and address of the publishing house<
(d) a declaration that the publication is issued under the authority of the Council<
(e) the serial number (if the publication is part of a series)< (f) the price of the publication.
5.1 If there is any lack of agreement on any issue between the members of the editorial board, the issue shall be referred to the consideration of the Council, and the Council’s decision is final.
5.2. The final draft of the publication, before being published or finalized, shall be approved by the Council.
5.3 The price of the publication shall be determined by the editorial board and approved by the Council.
