TELECOMMUNICATIONS (REGULATION) ACT (CAP. 399)Telecommunications (Leased Lines) (Amendment) (No.2) Regulations, 2003

IN exercise of the powers conferred upon him by article 38 of the Telecommunications (Regulation) Act, the Minister for Transport and Communications, after consultation with the Malta Communications Authority, has made the following regulations:–

1. (1) The title of these regulations is the Telecommunications (Leased Lines) (Amendment) (No.2) Regulations, 2003 and shall be read and construed as one with the Telecommunications (Leased Lines), Regulations 2003, hereinafter referred to as “the principal regulations”.

(2) These regulations shall be deemed to have come into force on the 11th February, 2003.

2. Regulation 3 of the principal regulations shall be amended as follows:

(a) in sub-regulation (1) thereof, for the words “at every point in Malta” there shall be substituted the words “to every point in Malta”; and
(b) in sub-regulation (2) thereof, for the words “requiring that authorised provider to provide at any point within a specific geographic area, a type of leased line” there shall be substituted the words “requiring that authorised provider to provide to any point, a type of leased line”.

3. In sub-regulation (2) of regulation 4 of the principal regulations, for the words “type of leased line offered in a particular geographic area” there shall be substituted the words “type of leased line offered to a particular geographical area”.4. In paragraph C of the Third Schedule to the principal regulations, for the words “regulation 7” there shall be substituted the words “regulation 6”.

5. In the Fifth Schedule to the principal regulations, for the words “(Regulation 9(1))” there shall be substituted the words “(Regulation 9(3))”.
