The Gieh Ir-Repubblika (Amendment) Act (Act No. Vi Of 2008)

AN ACT to amend :ie[ ir-Repubblika Act, Cap. 251

BE IT ENACTED by the President, by and with the advice and consent of the House of Representatives, in this present Parliament assembled, and by the authority of the same, as follows>

Title.

Cap. 251. Amendment of

article 8

of the principal Act.

1. The title of this Act is the :ie[ ir-Repubblika (Amendment) Act, 2008 and it shall be read and construed as one with the :ie[ ir- Repubblika Act, hereinafter referred to as “the principal Act”.
2. Sub-article (2) of article 8 of the principal Act shall be amended as follows>
(a) in paragraph (b) thereof, for the words “not more than twelve persons” there shall be substituted the words “not more than fifteen persons”<
(b) in paragraph (c) thereof, for the words “not more than twenty persons” there shall be substituted the words “not more than twenty-five persons”< and
(c) in paragraph (d) thereof, for the words “not more than one hundred persons” there shall be substituted the words “not more than one hundred and twenty-five persons”.
3. In subarticle (2) of article 12 of the principal Act, for the words “one hundred” wherever they occur there shall be substituted the words “one hundred and twenty-five”.
4. Immediately after article 14 of the principal Act, there shall be added the following new article>

“Conditions relating to awards.

Cap. 492.

14A. (1) Without prejudice to the provisions of article 14, the President may, in special circumstances, award the Midalja g[all-Qadi tar-Repubblika to a group of persons or a voluntary organisation which is duly enrolled with the Commissioner in terms of the Voluntary Organisations Act.
(2) Where the Midalja g[all-Qadi tar-Repubblika is awarded to a group or to an organisation, the Committee shall, in terms of subarticle (2) of article 18 of this Act, indicate the person belonging to the group or organisation who shall be entitled to have the letters M.Q.R. (Midalja g[all-Qadi tar-Repubblika) placed after his name on all occasions when the use of such letters is customary and to wear the medal as a decoration in accordance with the rules made under this Act.
(3) In the eventuality that the person, indicated in subarticle (2) hereof no longer forms part of the organisation, or the group, the President of Malta may, on the advice of the Prime Minister and following a recommendation to that effect by the Nominations Committee, nominate another person that appertains to such organisation or group who shall be entitled to have the M.Q.R. (Midalja g[all-Qadi tar-Repubblika) placed after his name on all occasions when the use of such letters is customary and to wear the medal as a decoration in accordance with the rules made under this Act and in such eventuality the person that no longer forms part of the organisation or the group will no longer have the right to have the letters M.Q.R. (Midalja g[all- Qadi tar-Repubblika) placed after his name on any occasions when the use of such letters is customary and to wear the medal as a decoration in accordance with the rules made under this Act. In such an eventuality the individual is to return the medal to the Secretary to the Cabinet.
(4) In the eventuality that the organisation, or the group mentioned in subarticle (2) hereof disbands, the President of Malta, on the advice of the Prime Minister and following a recommendation to that effect by the Nominations

Committee, may withdraw the Midalja g[all-Qadi tar- Repubblika. In such eventuality, the individual shall return the medal to the Secretary to the Cabinet.
(5) Where the Midalja g[all-Qadi tar-Repubblika is revoked in terms of subarticle (4) hereof, the provisions of subarticle (2) of article 23 shall apply.”.
5. Article 16 of the principal Act shall be amended as follows> (a) in sub-article (1) thereof, for the words “Long and
Efficient Service Medal, hereinafter in this article called the medal”
there shall be substituted the words “the Distinguished Service Medal, and a Medal to be known as the Long and Efficient Service Medal, hereinafter in this article called the medals,”< and
(b) in sub-article (4), paragraph (c) thereof, for the words “the Malta Prison Service” there shall be substituted the words “the Malta Correctional Services”.
6. In article 17 of the principal Act, for the words “Medal or a Long and Efficient Service Medal” there shall be substituted the words, “Medal, Distinguished Service Medal, or a Long and Efficient Service Medal”.
7. In subarticle (1) of article 18 of the principal Act, immediately after the words “the Chairman of this Committee.” there shall be added the words “One member of this Committee shall be appointed after consultation with the Leader of the Opposition.”.
