TRADING LICENCES ACT (CAP. 441)
Trading Licences (Amendment) Regulations, 2007
IN exercise of the powers conferred by article 28 of the Trading Licences Act, the Minister for Competitiveness and Communications has made the following regulations>-
1. (1) The title of these regulations is the Trading Licences (Amendment) Regulations, 2007 and they shall be read and construed as one with the Trading Licences Regulations, 2006 hereinafter referred to as “the principal regulations”.
(2) Regulations 2 and 7 of these regulations shall be deemed to have come into force on the 1st January, 2006.
2. For the title “Trading Licences (Amendment) Regulations,
2006” in bold at the top of the index to the principal regulations and in the beginning of the principal regulations themselves, there shall in both cases be substituted the title “Trading Licences Regulations, 2006”.
3. In regulation 8 of the principal regulations, for paragraph (a)
of sub-regulation (1) thereof there shall be substituted the following>-
“(a) that the Trading Licence Unit finds no objection to the issue of the licence>
(i) as applied for< or
(ii) subject to certain conditions as it may deem fit to apply< or”.
4. In regulation 9 of the principal regulations, for the first and second provisos of sub-regualtion (2) thereof there shall be substituted the following>-
“Provided that
(i) where the applicant fails to pay the licence fee within a period of three months from notification, the application for the issue of a licence shall no longer have any effect and should be considered as withdrawn<

Adds new regulation 55 to the principal regulations.

(ii) where the application refers to a licence for processing, manufacturing or sale of food products or beverages, listed under licence Category I under the First Schedule to these regulations or the providing of storage space for such items as a commercial service, the applicant shall also submit together with the licence fee, a declaration issued by the health authority, stating that the commercial premises comply with all sanitary and food safety requirements, and the Unit shall not issue the licence unless such declaration has been submitted<
(iii) where the application relates to the operation of a grain silo the applicant shall also submit a certification of compliance with the Plant Quarantine (Harmful Organisms) Regulations, 2004 by the Plant Health Department and any relevant regulations which may from time to time be in force.”.
5. In regulation 50 of the principal regulations, immediately after sub-paragraph (j) thereof there shall be added the following new paragraph (k)>
“(k) the fee payable in relation to a licence for the storage of grains shall be Lm100.”.
6. In the First Schedule to the principal regulations, in Licence category V – Professional and Business Services, there shall be added immediately after Type Code “63.11” and Type of Licence “Cargo Handling”, the following Type Code and Type of Licence respectively>
“63.12 Storage and Warehousing”.
7. Immediately after regulation 54 of the principal regulations, there shall be added the following new regulation>-

“Revokes L.N. 102 of 2002

.

55. The Trading Licences Regulations, 2002 are hereby being repealed.”.
