TRAFFIC REGULATION ORDINANCE (CAP. 65)
MALTA TRANSPORT AUTHORITY ACT (CAP. 332)
Traffic Regulation (Clamping and Removal of Encumbering
Objects) (Amendment) Regulations, 2003
IN exercise of the powers conferred by article 54 of the Traffic Regulation Ordinance, and by article 27 of the Malta Transport Authority
Act, the Minister for Transport and Communications has, after consultation with the Malta Transport Authority, made the following
regulations>-
1. (1) The title of these regulations is the Traffic Regulation (Clamping and Removal of Encumbering Objects) (Amendment)
Regulations, and they shall be read and construed as one with the Traffic Regulation (Clamping and Removal of Encumbering Objects)
Regulations Regulation, 1997, hereinafter referred to as “the principal regulations”.
(2) These regulations shall come into force on the 1st
January, 2004.
2. The provision in regulation 3 of the principal regulations shall be renumbered as sub-regulation (1) thereof and immediately
after sub-regulation (1) as renumbered there shall be added the following new sub-regulation>-
“(2) The Commissioner or the Council may remove any vehicle whose road licence has not been paid for any current year, whenever
the renewal of such licence is overdue by more than three months>
Provided that such vehicle shall not be returned to its owner unless and until the road licence of the said vehicle is paid in addition
to the fee levied by the Commissioner or the Council as stipulated in sub-regulations 9(b) and (c) of these Regulations>
Provided further that the provisions contained in these regulations applicable to encumbering objects shall also apply to any such
vehicle as is referred to in this sub-regulation.”.

3. For the proviso to sub-regulation (3) of regulation 8A of the principal regulations there shall be substituted the following>
“Provided that without prejudice to the right of the Commissioner or the Council to dispose of the derelict vehicle as aforesaid,
the Commissioner or the Council shall have the right to impose a fee of not more than Lm500.”.
4. Immediately after paragraph (c) of regulation 9 of the principal regulations there shall be included the following new paragraph>
“(d) for the disposal of derelict vehicles.........Lm500”.
