MALTA TRANSPORT AUTHORITY ACT (CAP. 332)
Traffic Regulation (Clamping and Removal of Encumbering
Objects) (Amendment) Regulations, 2006
IN exercise of the powers conferred by article 54 of the Traffic Regulation Ordinance, and by article 32 of the Malta Transport Authority Act, the Minister for Urban Development and Roads has, after consultation with the Malta Transport Authority, made the following regulations>–
1. The title of these regulations is the Traffic Regulation (Clamping and Removal of Encumbering Objects) (Amendment) Regulations, 2006 and they shall be read and construed as one with the Traffic Regulation (Clamping and Removal of Encumbering Objects) Regulations, 1997, hereinafter referred to as “the principal regulations”.
2. For regulation 1 of the principal regulations there shall be substituted the following>
“1. The title of these regulations is Clamping and Removal of Motor Vehicles and Encumbering Objects Regulations.”.
3. Immediately after the definition “maritime officer” there shall be added the following new definition>
“ “motor vehicle” means any mechanically self-propelled vehicle circulating on the road, other than a vehicle running on rails<”.
4. Sub-regulation (2) of regulation 3 of the principal regulations shall be amended as follows>
(a) for the word “vehicle”, wherever it appears, there shall be substituted the words “motor vehicle”< and
(b) immediately after sub-regulation (2) there shall be added the following new sub-regulation>

“(3) The Commissioner may also take possession of, remove and store motor vehicles which are on the road in breach of the Motor Vehicles Registration Tax Act or of the Motor Vehicle (Registration and Licensing) Regulations,
2004.”.
