TRAFFIC REGULATION ORDINANCE (CAP. 65)Motor Vehicles (Driving Licences) (Amendment) Regulations,2009

IN the exercise of the powers conferred by article 54 of the Traffic Regulation Ordinance, the Minister for Infrastructure, Transport and Communications has, after consultation with the Malta Transport Authority, made the following regulations: -

Substitutes regulation

7 of the principal regulations.

“Exchange of driving licences issued by other States.

7. Any holder of a European Union driving licence or of an Australian driving licence issued by all Australian State and Territory licensing authorities, who takes up normal residence in Malta, shall be entitled to have his driving licence exchanged for an equivalent Maltese licence.”.

Substitutes the Second Schedule to the principal regulations.

Amends the Third Schedule to the principal regulations.

Amends the Fourth Schedule to the principal regulations.

“Testing vehicles for categories B+E, C, C+E, C1, C1+E, D, D+E, D1 and D1+E which are not in conformity with the minimum criteria given above but which were in use on or before the 28th June, 2008, may still be used until the 30th September 2013. The requirements related to the load to be carried by these vehicles shall come into force on the 30th September, 2013.”.

“(iv) safe driving in road tunnels.”.

(a) for sub-paragraph (a) of paragraph 1 there shall be substituted the following:
“(a) The driving of a vehicle with manual transmission shall be subject to the passing of a skills and behaviour test taken on a vehicle with manual transmission.
If an applicant takes the test of skills and behaviour on a vehicle without a clutch pedal (or lever operated manually for categories A and A1) this shall be recorded on any licence issued on the basis of such a test. Licences with this indication shall be valid only for driving vehicles without a clutch pedal (or lever operated manually for categories A or A1).
For the purposes of this paragraph -
“Vehicles with automatic transmission” means a vehicle in which no clutch pedal (or lever operated manually for categories A or A1) is present.”;
(b) in item (viii) of sub-paragraph (c) of paragraph 2, immediately after the words “on long slopes;” there shall be inserted the word “tunnel;”;
(c) in item (viii) of sub-paragraph (d) of paragraph 3, immediately after the words “on long slopes;” there shall be inserted the word “tunnel;”; and
(d) in item (viii) of sub-paragraph (c) of paragraph 4, immediately after the words “on long slopes;” there shall be inserted the word “tunnel;”.

(a) for Sub-code No. 10.02 under Code 10 there shall be substituted the following:

Amends the Fifth Schedule to the principal regulations.

Amends the Seventh Schedule to the principal regulations.

“10.02 Vehicles without a clutch pedal (or lever operated manually for categories A or A1)”; and
(b) for Code No. 78 there shall be substituted the following:
“78 Valid only for vehicles without a clutch pedal
(or lever operated manually for categories A or A1)”.
